11:05 - 14/05/2021

June 3 - The first day the National Assembly discussed the 1992 Draft Constitutional Amendment at the conference hall - there were dozens of opinions of National Assembly deputies proposing to keep Article 10 of the Constitution's provisions on trade unions intact.

With accurate analysis, sharp arguments, as well as practice on the role of trade unions, the National Assembly deputies said that if trade unions are not placed in the right position, it will be a disadvantage.

The role of trade unions is indispensable in the Constitution

Delegate Tran Van Tu (Dong Nai) was the first to post an analysis, proposing to keep Article 10 of the current Constitution regulating the organization of trade unions. According to the private delegate, the Trade Union is a socio-political organization of the working class and right from the 1980 Constitution clearly stipulates this. At present, in the period of industrialization and modernization of the country, the role of the Trade Union is increasingly consolidated and grown. Therefore, "the role of trade unions is indispensable in the Constitution", delegate Tran Van Tu concluded and emphasized: It is necessary to keep Article 10 on trade union organization not only to ensure the operation of trade unions, but also and the growth of the working class - an organization that ensures a balanced development between the rights and obligations of workers. "If there is no trade union organization and the trade union is not placed in the right position, it will be a disadvantage" - delegate Tran Van Tu affirmed.

Agreeing with the opinion of Delegate Tran Van Tu, Delegates Nguyen Doan Khanh (Phu Tho), Delegate Huynh The Ky (Ninh Thuan) in their speeches also gave in-depth analyzes on both Theoretically and practically, it is proposed to keep Article 10 on the role of the working class in society.

Thoroughly analyzing the issues surrounding Article 10 of the current Constitution, Representative Y Khut Nie (Dak Lak) said that first of all, Article 10 should be maintained according to the draft submitted to the people, and at the same time added adding the phrase "large" after the phrase "socio-political", for the following reasons: Firstly, the phrase "large" will reflect more fully and clearly the nature of the working class and the organization Trade union organization is a powerful force with many components and subjects participating in the trade union organization. Second, maintain Article 10 on roles and functions of trade unions. That is, thoroughly grasping the Politburo's guiding view on the content of amending the 1992 Constitution that only amend issues that are clear, proven to be true in practice, and have enough grounds; and the issues are not clear, it is not necessary to modify it, it can't be fixed if it can't be fixed.

Delegate Y Khut Nie analyzed: The working class is the leading class of the Vietnamese revolution, through the vanguard of the Communist Party of Vietnam, whose representative organization is the Trade Union. Thus, defining the roles, functions and tasks of the trade union organization in Article 10 of the current Constitution is reasonable, correct, affirming the class nature of the Party, inheriting and developing. in a positive direction. On that basis, the Trade Union continued to better perform its roles, functions and tasks in the organization to implement the Party's goals and resolutions. That is in line with the spirit of Resolution 20 of the 10th Party Central Committee on continuing to build the Vietnamese working class in the period of accelerating industrialization and modernization of the country.

Delegate Giang Thi Binh (Lao Cai), with arguments from history and reality, affirmed: “Regarding Article 10, I agree to choose option 2, because practice has proven that the Trade Union is a major organization. Socio-political organizations have many characteristics that distinguish them from other socio-political organizations. Therefore, trade unions have been enshrined in the Vietnamese Constitution for nearly 55 years. Trade unions always perform well their functions and tasks, being a large socio-political organization of the working class and workers. In which, the working class is the pioneer army in the cause of national construction and defense, the leading force in the cause of industrialization and modernization of the country; at the same time is the core force of the alliance of the working class, the peasantry and the intelligentsia, ensuring the economic and social development of the country. Therefore, it is absolutely right to retain Article 10 of the provisions on the organization of Vietnam's Trade Union as the draft announced to continue to affirm the importance of the Trade Union.

Exciting "Desk for Article 10" in the corridor of the National Assembly

Talking to the Lao Dong reporter during a break, Delegate Tran Van (Ca Mau) - Deputy Chairman of the National Assembly's Finance-Budget Committee - shared: Article 10 of the current Constitution needs to be preserved. for many reasons, including the reason that Article 10 has been stable in our Constitution for nearly 55 years now. The more complicated the situation, the more urgent the issue of protecting the legitimate interests of the working class and workers is raised. Therefore, there is no reason to drop Article 10.

Also according to Delegate Tran Van: Vietnam trade union organization is the representative organization of the working class. The more the economy develops, the more the working class develops and grows, the more important the role of trade unions becomes. Therefore, the legal status constitution to enhance the role of trade unions is extremely necessary. Commenting on the idea of bringing the trade union organization together with other social organizations for "equality", Delegate Tran Van said that the position, role and historical mission of the working class is which has been confirmed by history and revolutionary practice as well as the reality of national construction and development. The fact that the constitutions have separate articles regulating the organization not only proves that, but also affirms the class nature of the Party and the State.

Delegate Tran Ngoc Vinh (Hai Phong) also spent most of the break in the middle of the discussion session on the morning of June 3 to share with press reporters what NE is interested in. Delegate Tran Ngoc Vinh asserted: Keeping Article 10 is one of the big issues and many people support it. Article 10 should not be included in Article 9. “There are many opinions that there are 6 socio-political organizations, then there are 6 Each organization has a function, an important organization, but a trade union is one of the most important institutions. The party belongs to the working class, the workers are the vanguard. Trade unions are assigned the task of protecting the interests of the working class... Therefore, it is impossible to combine Article 10 of the provisions on trade union organizations with other organizations," said Representative Tran Ngoc Vinh.

Delegate Vinh analyzed, according to the direction of the HP revision board, saying that what is stable is left as is. Our college is developing, why should we include it? Previously, I have argued a lot before leaving it alone. Now why delete it? Some hostile forces have skewed towards Article 4, if not, they will turn to the CCP. "The Party is like a tree, has many roots, the union is the big root, if abandoned, it will be weakened" - Representative Tran Ngoc Vinh emphasized and earnestly proposed to keep Article 10 of the provisions on union organization in the current Constitution.

Maintain Article 10 and add a review function

As noted by the reporter of Labor, on the National Assembly forum on June 3, there were some opinions that should not keep Article 10 on trade unions in the current Constitution, but should be included in Clause 2, Article 9; However, these opinions only make such a proposal without any analysis and explanation for that proposal. Responding to our questions, Representative Tran Ngoc Vinh (Hai Phong) said that some people have such opinions due to lack of in-depth research and lack of awareness of the representative nature of a production method, as well as different roles of the Vietnamese working class. Representative Dang Ngoc Tung also shared with the press that the delegates in the industrial city were very interested in unions and chose to keep Article 10 of the Constitution for many good reasons, especially when Vietnam is developing a lot. economic sectors. The Constitution clearly states that, above all, protecting the rights of workers must have a union. “We aim to become an industrial country by 2020, but it is impossible to promote industrialization and modernization without workers? Remaining is that Article 10 is absolutely necessary and needs to supplement the review function.” - Representative Dang Ngoc Tung emphasized.
